WARRANTY DISCLAIMER
THE PRODUCTS AND SERVICES ARE PROVIDED TO YOU “AS IS WITH ALL FAULTS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. ORB INNOVATIONS AND ITS, AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES, HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCTS AND SERVICES WHETHER EXPRESS OR IMPLIED AND EXPRESSLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, AND NON-INFRINGEMENT.
ORB INNOVATIONS DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SERVICES, THE AVAILABILITY OF CONTENT, THAT THE FUNCTIONS CONTAINED IN THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THE SERVICES WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS IN THE SERVICES WILL BE CORRECTED, OR THAT THE FUNCTIONS CONTAINED IN THE SERVICES WILL FUNCTION WITH OTHER MOBILE APPS OR HARDWARE, OR WITHIN A SYSTEM. ANY REMEDY AVAILABLE UNDER THIS WARRANTY IS LIMITED BY THE PRICE YOU PAID FOR THE PRODUCT.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY ORB INNOVATIONS OR AN ORB INNOVATIONS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
ORB SPORT LIMITED WARRANTY
Notwithstanding the foregoing, ORB Innovations provides the following limited warranty for ORB Sport:
COVERAGE
This warranty covers defects for ORB Sport, specifically the smart mouthguard and charging case ("Products") purchased directly from ORB Innovations.
DURATION OF COVERAGE
ORB Innovations provides a limited warranty of six (6) months from the date of delivery if the failure is due to defects in materials or workmanship. If your local law in effect at the time of purchase requires a warranty period longer than six (6) months, this warranty shall be extended to the extent required by such law. Replacements or repairs assume the remaining warranty of the original Products.
WHAT ORB INNOVATIONS WILL DO
ORB Innovations will replace, repair or refund, at their option, any defective or malfunctioning Product at no charge.
WHAT THIS WARRANTY DOES NOT COVER
This warranty will be considered void if any of the following conditions are met:
- Failure to follow the provided instructions for use or maintenance.
- Use of the Products in a manner inconsistent with their intended purpose.
- Damage caused by accidents, negligence, misuse, or abuse, including removing the smart mouthguard from the mouth and chewing on the mouthguard, pets chewing on the mouthguard, or exposure of the Products to extreme temperatures (greater than 100 degrees Fahrenheit or lower than 14 degrees Fahrenheit).
- Unauthorized modifications, alterations, or repairs to the products.
- Failure to provide proof of purchase or any required documentation.
Additionally, ORB Innovations makes no warranty for any ORB Sport smart mouthguard or charging case purchased from dentists or other sellers. ORB Innovations is not responsible for warranties made by other sellers.
ORB Innovations reserves the right to make the final determination on whether a warranty claim is valid and whether specific actions or conditions void the warranty. ORB Innovations' decision shall be final and binding.
HOW TO SUBMIT A CLAIM
To submit a warranty claim, you can call our ORB Support team at 866-499-0058 for assistance. ORB Innovations will cover any shipping costs related to fulfilling your valid warranty claim. If the issue is related to the mouthguard fit, ORB Innovations will send you a new impression kit. ORB Innovations must receive the defective Products from you before providing a new mouthguard or charging case.
